IRS Moves to Dismiss FFRF Lawsuit Concerning Churches and Campaign Intervention

ECFA previously reported on the federal lawsuit filed by the Freedom From Religion Foundation (FFRF) in November 2012 demanding the IRS enforce the tax code’s campaign intervention prohibition against churches.

The IRS has filed a motion to dismiss the FFRF suit, arguing that “the entire premise of FFRF’s Complaint is demonstrably false” and that the group’s complaint is not proper because the federal court lacks subject matter jurisdiction to hear the case.
